Welcome to PokéBase (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://pokebase.ph (“Site”), including any related services, features, or content, including our e‑commerce platform for buying and selling Pokémon cards (“Shop”). By accessing or using the Site and Shop, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Site and Shop. By using the Site or making a purchase, you represent and warrant that you meet this age requirement.

2. Accounts

  1. Registration. To purchase items from our Shop or access certain features, you may register for an account. You agree to provide accurate and complete information and to keep your account credentials secure.
  2. Account Responsibility. You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

3. Purchases and Payment

  1. Order Placement. When you place an order, you make an offer to purchase products listed in your shopping cart. All orders are subject to acceptance and availability.
  2. Pricing. Prices displayed on the Site are in Philippine Peso (PHP) and include applicable taxes unless otherwise noted. We reserve the right to change prices at any time.
  3. Payment Methods. We only accept bank transfers. By submitting payment information, you represent that you have the right to use the chosen payment method.
  4. Authorization and Fraud Prevention. All payments are subject to validation and authorization. We may cancel or refuse orders where fraud or unauthorized transactions are suspected.

4. Shipping and Delivery

  1. Shipping Options. We offer shipping methods and rates as displayed during checkout. Estimated delivery times are provided but not guaranteed.
  2. Risk of Loss. Title and risk of loss pass to you upon delivery to the carrier.

5. Returns and Refunds

  1. Return Policy. We accept returns of eligible items within 14 days of delivery, provided items are unopened and in original condition. Custom or sealed booster boxes may be non‑returnable.
  2. Return Process. To initiate a return, contact [email protected] with your order number and reason. We will provide return instructions and, upon receipt and inspection, issue a refund less shipping and handling fees.
  3. Refunds. Refunds will be processed to your original payment method within 7 business days after we receive the returned items.

6. Product Descriptions and Availability

  1. Accuracy. We strive to accurately describe products, including rarity, set, and condition. Slight variations may occur due to supplier changes or human error.
  2. Availability. All items are subject to availability. In rare cases of overselling, we will notify you promptly and offer a refund or alternative product.

7. Intellectual Property

  1. Ownership. All content on the Site, including text, graphics, logos, images, and software, is our property or licensed to us and protected by intellectual property laws.
  2. Limited License. You are granted a limited, non‑exclusive, non‑transferable license to access and use the Site for personal, non‑commercial purposes.
  3. Prohibited Use. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

8. User Conduct

When using the Site or Shop, you agree not to:

  • Violate any applicable laws or regulations.
  • Upload or transmit harmful, illegal, or infringing content.
  • Interfere with security-related features or reverse engineer the Site.

9. Disclaimers and Limitation of Liability

You agree to indemnify and hold harmless PokéBase and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Site, violation of these Terms, or infringement of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them shall be governed by the laws of the Republic of the Philippines. Any legal action shall be brought exclusively in the courts located in Manila, Philippines.

12. Changes to These Terms

We may modify these Terms at any time. We will post the updated Terms on this page with a new “Last updated” date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
